The Shift from Open Platforms to Digital Commons | Open Thoughts | Peer2Politics | Scoop.it

We are accustomed to regarding open platforms as synonymous with greater freedom and innovation. But as we have seen with the rise of Google, Facebook and other tech giants, open platforms that are dominated by large corporations are only “free” within the boundaries of market norms and the given business models. Yes, open platforms provide many valuable services at no (monetary) cost to users. But when some good or service is offered for at no cost, it really means that the user is the product. In this case, our personal data, attention, social attitudes lifestyle behavior, and even our digital identities, are the commodity that platform owners are seeking to “own.”

Envisioning Autonomous Dispute Resolution (AutoArb)

Several commentators within the Digital Common Law Institute (DCLI) forums have suggested that a logical place to start examining the the digital network implications of law should be with regards to the sales of goods. The Uniform Commercial Code (UCC), nearly universally adopted by the fifty states, provides certainty in the execution of contracts no matter where buyers and suppliers may originate within the U.S.  DCLI has the opportunity to provide a certain amount of stability when transacting business through the transnational jurisdiction of the internet.  A digital common law can assist in the mechanisms for dispute resolution resulting from “smart contract” for the sale of goods.
